Terms of Service

These terms govern your use of ServisPulse. By using the platform, you agree to be bound by the conditions described below. Please read them carefully.

Welcome to ServisPulse. By accessing or using our platform — including our web application, APIs, and related services (collectively, the “Service”) — you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a church, ministry, or organization, you represent that you have the authority to bind that entity to these Terms.


1. Who May Use the Service

You must be at least 16 years old to create an account. By registering, you represent that all information you provide is accurate, current, and complete, and that you will keep it updated. Accounts are intended for use by church administrators, department leaders, and authorized stewards of a registered church organization. You are solely responsible for all activity that occurs under your account credentials.

2. Account Registration and Security

To access the Service, you must create an account and verify your email address with a one-time code sent at registration. You are responsible for maintaining the confidentiality of your login credentials and for restricting access to your device. You must notify us immediately at support@servispulse.app if you suspect unauthorized access. ServisPulse is not liable for losses resulting from unauthorized use of your account where you failed to safeguard your credentials or notify us promptly.

3. The Service — What We Provide

ServisPulse is a church steward attendance management platform. The Service includes, but is not limited to:

  • QR code and 6-digit code check-in for church services and events
  • Steward profile management, including custom ID generation and attendance history
  • Department and branch organization and management
  • Attendance analytics, department health reporting, and at-risk steward identification
  • Admin and team management with role-based access controls and invitation workflows
  • Transactional email notifications (verification, password reset, attendance alerts)
  • Branding and customization tools (church logo, colors, branded check-in links)

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice to active subscribers. We will not be liable to you or any third party for any such modification, suspension, or discontinuance where reasonable notice has been provided.

4. Acceptable Use

You agree to use the Service only for lawful, church-related organizational purposes and in accordance with these Terms. You must not:

  • Use the Service to harass, threaten, intimidate, or harm any individual
  • Upload or transmit malicious code, viruses, or software intended to disrupt the Service or its users
  • Attempt to gain unauthorized access to any part of the Service, its underlying infrastructure, or other users' accounts
  • Scrape, crawl, or systematically extract data from the Service without our prior written consent
  • Resell, sublicense, or commercially exploit the Service in ways not expressly permitted by these Terms
  • Use the Service to collect or process personal data in violation of applicable privacy laws
  • Impersonate another person or misrepresent your affiliation with any organization
  • Use the Service in any manner that could damage, overburden, or impair its performance or availability for other users

We reserve the right to suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have materially violated any of the above conditions.

5. Church Data and Steward Personal Information

You acknowledge that your church is the data controller for all steward personal information entered into the Service — including names, email addresses, phone numbers, attendance records, and any related profile data. ServisPulse acts as a data processor on your behalf.

As a church administrator, you are responsible for:

  • Obtaining appropriate informed consent from stewards before entering their personal information into the Service
  • Informing stewards how their data is used, who can access it, and how long it is retained
  • Ensuring your use of steward data complies with applicable data protection laws in your jurisdiction (including, where applicable, GDPR, NDPR, and CCPA)
  • Maintaining accurate, current, and complete steward records
  • Responding to steward requests to access, correct, or delete their data in a timely manner

ServisPulse will never use steward data for any purpose beyond delivering the Service to the church that controls it. We do not share, sell, or use steward personal data for advertising or third-party commercial purposes. For full details, see our Privacy Policy.

6. Subscription Plans and Payment

ServisPulse offers a free Starter plan and paid subscription plans (Growth, Pro, Enterprise). Paid plans are billed on a monthly or annual basis as selected at checkout. By subscribing to a paid plan, you authorize us to charge your payment method on file at the agreed billing interval.

  • Free Trial: Paid plans include a 14-day free trial. You will not be charged until the trial period ends. You may cancel at any time before the trial concludes to avoid charges.
  • Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for unused portions of a billing period.
  • Price Changes: We will provide at least 30 days' advance notice before changing subscription pricing. Continued use of the Service after a price change constitutes your acceptance of the new pricing.
  • Taxes: Prices displayed are exclusive of applicable taxes. You are responsible for all taxes and duties arising from your subscription in your jurisdiction.
  • Plan Downgrades: If you downgrade to a lower-tier plan, your data will be preserved, but access to higher-tier features and steward capacity will be restricted in line with your new plan.
  • Failed Payments: If a payment fails, we will notify you and attempt reprocessing. Access may be suspended after reasonable notice if the outstanding balance is not resolved.

7. Intellectual Property

The Service, including its design, source code, interface, content, logos, trademarks, and all associated intellectual property, is owned exclusively by ServisPulse and is protected under applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited, non-exclusive, non-transferable license to use it as described herein.

You retain full ownership of all content and data you upload to the Service, including church logos, steward information, and branding assets (“Your Content”). By uploading Your Content, you grant ServisPulse a limited, non-exclusive, royalty-free license to store, display, process, and transmit Your Content solely as necessary to operate and deliver the Service to you. This license terminates upon account closure.

8. Data Retention and Deletion

We retain your church's data for as long as your account remains active. Upon account closure, all associated data — including church records, steward profiles, and attendance history — will be permanently deleted within 90 days, except where retention is required by applicable law. You may request early deletion of your data at any time by contacting support@servispulse.app. Deleted data cannot be recovered after the applicable retention period has elapsed.

9. Third-Party Services

The Service integrates with and relies upon the following third-party infrastructure providers:

  • Convex — backend database and cloud infrastructure
  • Resend — transactional email delivery
  • ImageKit — image storage, optimization, and delivery

Your use of the Service is subject to the terms and privacy policies of these providers. ServisPulse is not responsible for the practices, availability, or performance of third-party services. We select and vet our providers carefully, but we cannot guarantee uninterrupted service where failures originate from third-party infrastructure.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SERVISPULSE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS ENTIRELY AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERVISPULSE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF REVENUE, LOSS OF PROFITS, OR BUSINESS INTERRUPTION — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS YOU PAID TO SERVISPULSE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100).

12. Indemnification

You agree to indemnify, defend, and hold harmless ServisPulse and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or access to the Service; (b) your violation of any provision of these Terms; (c) your violation of any applicable law or the rights of a third party; or (d) any data, content, or information you submit to or through the Service.

13. Termination

Either party may terminate the agreement formed by these Terms at any time. You may close your account from your account settings. We may suspend or terminate your access to the Service at any time, with or without prior notice, if we reasonably believe you have violated these Terms, applicable law, or the rights of a third party.

Upon termination, your right to access and use the Service ceases immediately. The following sections survive termination: 5 (Steward Data), 7 (Intellectual Property), 10 (Disclaimer), 11 (Liability), 12 (Indemnification), and 14 (Governing Law).

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. In the event of a dispute arising from or related to these Terms or the Service, the parties agree to first attempt resolution through good-faith negotiation for a period of 30 days. If the dispute is not resolved within that period, it shall be submitted to binding arbitration in accordance with applicable arbitration rules, or, where arbitration is not available or enforceable, to the courts of competent jurisdiction.

15. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our Service, applicable law, or business practices. When we make material changes, we will update the effective date at the top of this page and notify you by email at least 14 days before the changes take effect. For non-material changes, the updated Terms will be posted immediately. Your continued use of the Service after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
